STOCKSPEAK PRIVACY POLICY

1. Introduction

StockSpeak (“we,” “our,” or “us”) is operated by 45 Degrees, Inc., a Wyoming corporation. This Privacy Policy describes how we collect, use, disclose, and protect your personal information when you access or use the StockSpeak platform at stockspeak.com, including all associated websites, mobile applications, features, and services (collectively, the “Service”).

By accessing or using StockSpeak, you acknowledge that you have read, understood, and agree to be bound by this Privacy Policy. If you do not agree, please do not access or use the Service.

2. Information We Collect

2.1 Information You Provide Directly

  • Account Registration: When you create an account, we collect your name, email address, password, and optional profile information such as your investing experience, preferred sectors, and risk tolerance.
  • Influencer Applications: If you apply to become a verified influencer on StockSpeak, we collect additional information including your biography, investing style, sector focus, risk profile, social media handles (LinkedIn, X/Twitter), research samples (uploaded PDFs), and payment information for the application fee.
  • Company/Issuer Accounts: If you are a company or issuer representative creating or managing a landing page on StockSpeak, we collect your name, title, company information, contact details, and billing information.
  • Community Participation: When you post in discussion forums, submit stock picks, leave comments, vote on content, or otherwise participate in the community, we collect the content you create and associated metadata (timestamps, sentiment tags, ticker symbols).
  • Communications: When you contact us directly via email, support forms, or other channels, we collect the content of those communications.
  • Payment Information: When you make purchases (including influencer application fees or premium subscriptions), we collect billing details. Payment card information is processed by our third-party payment processor and is not stored on our servers.

2.2 Information Collected Automatically

  • Usage Data: We collect information about how you interact with StockSpeak, including pages visited, features used, search queries, clicks, time spent on pages, and referring URLs.
  • Device and Browser Information: We collect your IP address, browser type and version, operating system, device identifiers, screen resolution, and language preferences.
  • Cookies and Tracking Technologies: We use cookies, web beacons, pixels, and similar technologies to collect usage data, remember your preferences, and support analytics. See Section 7 (Cookies and Tracking Technologies) for details.
  • Analytics: We use Google Analytics (GA4) and similar tools to understand platform usage. These tools may collect information about your activity across websites and services using cookies and similar technologies.

2.3 Information From Third Parties

  • Social Media Platforms: If you link your social media accounts (X/Twitter, LinkedIn, Discord) to StockSpeak, we may receive profile information and, for opted-in influencers, publicly available stock picks and posts from those platforms.
  • Financial Data Providers: We obtain stock pricing, market data, and company financial information from third-party data providers such as Financial Modeling Prep (FMP) and TwelveData. This is market data, not personal information.

3. How We Use Your Information

We use the information we collect for the following purposes:

  • Provide and Operate the Service: To create and maintain your account, display your profile and activity, publish your stock picks and forum posts, calculate and display performance metrics (such as average peak gain, win rate, and return badges), and deliver features you request.
  • Influencer Verification and Track Records: To build, verify, and publicly display influencer track records, including timestamped stock picks, performance metrics, and badges. This is a core feature of StockSpeak and a key part of the value you receive.
  • Company Landing Pages and Investor Relations: To publish and maintain company landing pages, display community activity and sentiment related to specific tickers, and provide issuers with analytics about engagement with their pages.
  • Communications: To send you service-related messages, account notifications, security alerts, and, with your consent, marketing communications including newsletters and SMS alerts.
  • Analytics and Improvement: To understand how the Service is used, identify trends, diagnose technical issues, and improve features and user experience.
  • Safety and Security: To detect and prevent fraud, abuse, spam, and other harmful activity, and to enforce our Terms and Conditions.
  • Legal Compliance: To comply with applicable laws, regulations, and legal processes.

4. Public Information and Transparency

StockSpeak is built on transparency. Certain information you provide is displayed publicly by design:

  • Influencer Profiles: If you are a verified influencer, your profile — including your display name, biography, investing style, sector focus, stock picks, entry prices, average peak gain, win rate, badges, and performance history — is publicly visible. This information is timestamped and immutable once published. You cannot retroactively edit or delete published stock picks.
  • Forum Posts and Comments: Content you post in community discussion forums is publicly visible and attributed to your username. Sentiment tags, upvotes/downvotes, and associated metadata are also public.
  • Leaderboards and Badges: Your position on leaderboards, points, and any badges earned (e.g., 5x return, 10x return) are publicly visible.

This transparency is fundamental to StockSpeak’s purpose of providing verified, trustworthy investment information. Please be thoughtful about the information you share through the Service.

5. How We Share Your Information

We do not sell your personal information. We may share your information in the following circumstances:

  • With Issuers/Companies: If you interact with a company landing page (e.g., opt into an email list, subscribe to SMS alerts, or participate in a ticker-specific community), the sponsoring company may receive aggregated analytics about community engagement. We do not share your personal contact information with issuers unless you explicitly consent (e.g., by opting into their communications).
  • Service Providers: We share information with third-party vendors who perform services on our behalf, including payment processing, email delivery, SMS delivery, hosting, analytics, and customer support. These providers are contractually required to use your information only as necessary to provide services to us.
  • Legal Requirements: We may disclose your information if required by law, regulation, legal process, or governmental request, or if we believe disclosure is necessary to protect our rights, your safety, or the safety of others.
  • Business Transfers: In the event of a merger, acquisition, reorganization, bankruptcy, or sale of assets, your information may be transferred as part of that transaction. We will notify you of any such change.
  • With Your Consent: We may share your information for any other purpose with your explicit consent.

6. Email and SMS Communications

StockSpeak offers email newsletters and SMS alerts related to stock picks, market news, and platform activity.

  • Opt-In Required: We use double opt-in for email subscriptions. You will receive a confirmation email before being added to any mailing list. SMS alerts require explicit consent with disclosure of message frequency.
  • Unsubscribe: Every marketing email includes an unsubscribe link. You may opt out of SMS alerts at any time by replying STOP. We process unsubscribe and STOP requests promptly.
  • Compliance: We comply with the CAN-SPAM Act, TCPA, and applicable anti-spam laws. Our emails include our physical mailing address and accurate sender information.

7. Cookies and Tracking Technologies

We use the following categories of cookies and similar technologies:

  • Strictly Necessary Cookies: Required for the Service to function, including session management, authentication, and security. These cannot be disabled.
  • Analytics Cookies: Used to understand how visitors interact with StockSpeak, including Google Analytics (GA4). These help us measure traffic, identify popular content, and improve the user experience.
  • Functional Cookies: Used to remember your preferences, such as display settings and watchlist selections.
  • Advertising and UTM Tracking: We use UTM parameters and conversion tracking to measure the effectiveness of marketing campaigns and referral sources. We may use these in connection with Google Ads or other advertising platforms.

You can manage cookie preferences through your browser settings or through our cookie consent banner. Disabling certain cookies may limit your ability to use some features of the Service.

8. Data Retention

We retain your personal information for as long as your account is active or as needed to provide you with the Service.

  • Account Data: Retained for the life of your account and for a reasonable period after account closure for legal, audit, and compliance purposes.
  • Influencer Track Records: Stock picks, timestamps, and performance data published to influencer profiles are retained indefinitely as part of the platform’s public record. This data integrity is a core feature of StockSpeak.
  • Forum Content: Public forum posts and comments are retained indefinitely unless removed by moderators for policy violations.
  • Analytics Data: Aggregated and anonymized analytics data may be retained indefinitely.

If you request account deletion, we will remove your personal account information. However, publicly posted content (forum posts, stock picks, influencer track records) that has been relied upon by other users may be retained in anonymized or attributed form to preserve platform integrity.

9. Data Security

We implement reasonable technical and organizational measures to protect your personal information, including:

HTTPS encryption on all connections (SSL/TLS); encryption of data at rest and in transit; password hashing using bcrypt or equivalent algorithms; secure session management with auto-expiring tokens; regular security assessments and monitoring; and access controls limiting employee and contractor access to personal information.

No method of transmission over the Internet or electronic storage is 100% secure. While we strive to protect your information, we cannot guarantee absolute security.

10. Your Rights and Choices

Depending on your jurisdiction, you may have the following rights regarding your personal information:

  • Access and Portability: You may request a copy of the personal information we hold about you.
  • Correction: You may request correction of inaccurate personal information.
  • Deletion: You may request deletion of your personal information, subject to our retention obligations and the public nature of certain platform data as described in Section 8.
  • Opt-Out of Communications: You may unsubscribe from marketing emails and SMS alerts at any time as described in Section 6.
  • Cookie Preferences: You may manage cookies through your browser or our cookie consent tool.

10.1 California Residents

If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA), including the right to know what personal information we collect, the right to delete, the right to opt out of the sale of personal information (we do not sell your information), and the right to non-discrimination for exercising your privacy rights.

10.2 European Economic Area, United Kingdom, and International Users

If you are located in the EEA, UK, or another jurisdiction with applicable data protection laws, you may have additional rights under the General Data Protection Regulation (GDPR) or equivalent legislation, including the right to lodge a complaint with a supervisory authority and the right to data portability. Our legal bases for processing include your consent, the performance of our contract with you, our legitimate interests, and compliance with legal obligations.

11. Children’s Privacy

StockSpeak is not directed to individuals under the age of 18. We do not knowingly collect personal information from children. If we learn that we have collected personal information from a child under 18, we will take steps to delete that information promptly. If you believe a child has provided us with personal information, please contact us.

12. Third-Party Links and Services

StockSpeak may contain links to third-party websites, services, and embedded content (including social media posts, YouTube videos, and external research). We are not responsible for the privacy practices of these third parties. We encourage you to review the privacy policies of any third-party services you access through StockSpeak.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes, we will notify you by posting the updated policy on this page with a revised effective date and, where appropriate, by email or in-app notification. Your continued use of StockSpeak after changes become effective constitutes your acceptance of the revised policy.
